When a dispute is brought before a judicial authority, the trial opens and strict rules must be respected. The law provides that each party must allege and prove all the facts it intends to rely on.
This is a technical and delicate task, whatever the area of law involved (protection of personality (including measures against violence and harassment), civil liability, law of obligations, etc.).
Hearings are systematically held as part of legal proceedings, during which the parties must support their positions and know the ins and outs of the dispute so that, if approriate, they can negotiate a settlement with full knowledge of the facts.
