Fees

Our lawyers usually charge between CHF 350.00 and CHF 500.00 per hour, depending on the complexity, urgency and importance of the case or the result obtained. All rates are exclusive of VAT.

Transparency is essential if our customers are to retain control of the amounts involved in their case. That’s why, when setting a retainer, our lawyers make every effort to inform their clients as precisely as possible about the services included in the retainer, as well as any additional costs to be expected.

In the event of a complicated financial situation, you can apply for legal aid in the event of legal proceedings. In such circumstances, you need to fill in a form, attach all the required appendices and hand it over to the lawyer of your choice. We will, of course, be happy to help you do this.

We also can be creative in our pricing models, as hourly rates do not necessarily lend themselves to all situations. We are open to alternative methods of remuneration, such as lump-sum payments or fees that are partially dependent on the judgment or settlement obtained (pactum de palmario). However, fees that are purely proportional to the outcome of the case (pactum de quota litis) are prohibited under Swiss law.

Flat rate offers

To offer our clients greater predictability, we offer lump-sum services, to be agreed with our lawyers. For our counseling activity, we offer flat rate packages in the following areas in particular:

Corporate law:

Corporate housekeeping

According to Article 699 para. 2 of the Swiss Code of Obligations, the Annual General Meeting of your limited company must be held “within six months of the end of the financial year”. The same applies to LLCs. This requirement is often not met.

For CHF 2,000 (excl. VAT), we will prepare all the documents you need for your Annual General Meeting, i.e.:

– Management report ;
– Decisions and recommendations of the Board of Directors;
– Notice of General Meeting; and
– Minutes of the Annual General Meeting.

Data protection:

Privacy policy

Since the new Data Protection Act came into force, you may be subject to a number of new obligations. In this context, a privacy policy is often necessary.

For CHF 700 (excl. VAT), we will draw up your privacy policy. This includes a one-hour telephone consultation to assess your needs and adapt the initial draft.

Data Protection Officer (DPO)

For CHF 400 (excl. VAT) per month, our firm can provide you with a data protection officer in accordance with art. 10 of the Data Protection Act.

This flat-rate fee includes a listing on the portal of the Swiss Federal Data Protection and Information Commissioner, as well as 12 hours of legal advice per year in the field of data protection.

Start-ups:

Fund raising rounds

Lawyers are often unaffordable for start-ups. We offer you a more affordable and predictable rate for your financing round.

For CHF 650 (excl. VAT) per month, we will review or draft all the legal documents you need, including term sheets, convertible loans, cap tables, minutes of general meetings or board meetings.

In the event of successful fund-raising, we also charge a 2% success fee.

Trademarks: registration and availability searches

Filings

Effective trademark protection is more complex than filling in a simple form. Your list of goods and services must be drafted with the utmost care. Otherwise, your trademark may well give you only the illusion of protection.

As a guide, we offer the following flat rates for trademark registration:

– Switzerland: from CHF 850 (excl. VAT; official filing fees not included);
– European Union: from CHF 1,300 (excl. VAT; plus official filing fees).

Availability searches

Performing a prior art search before registering your trademark can be crucial. By checking whether an identical or similar trademark already exists, you avoid not only having your trademark opposed, but also significant costs associated with litigation or rebranding.

– Switzerland: from CHF 1,700 (excl. VAT) ;
– European Union : from CHF 4,600 (excl. VAT) ;
– Worldwide : from CHF 8,900 (excl. VAT).

Trademarks: monitoring and management

Monitoring your trademarks is essential to protect your rights. In Switzerland, the Institute of Intellectual Property does not warn you of potential threats, such as unauthorized use or registration of similar trademarks by third parties. Proactive vigilance is therefore essential to preserve your exclusivity.

Your brand portfolio must also evolve with your business: new markets, new products, new challenges. We offer you a package to manage these challenges. Our service includes rigorous monitoring of registers using modern tools, management of administrative renewals and an annual assessment of your portfolio.

As a guide, we offer the following all-inclusive rates for the monitoring and management of your trademark:

– Switzerland: from CHF 950 / year (excl. VAT) ;
– European Union : From CHF 1,850 / year (excl. VAT) ;
– Worldwide : From CHF 2,900 / year (excl. VAT).
